Supreme Court dismisses Magnus Abe’s suit on Rivers APC primaries

The Supreme Court has dismissed a suit filed by a factional leader of the All Progressives Congress in Rivers State Magnus Abe challenging the party’s governorship primaries in the State.

Independent National Electoral Commission excluded the APC governorship and House of Assembly candidates from the March 4 general elections following the controversies that trailed the party’s primary held in October 2018.

Abe on March 1 sought the court to rule against the Rivers State governorship primaries and make a final pronouncement on the legality of both direct and indirect primary polls conducted by the two factions of the party in 2018.

The acting chief justice of Nigeria (CJN) Ibrahim Mohammed, said Abe’s application lacks merit and therefore the suit is incompetent and a gross violation of order 2 rule 8 of the Supreme Court.

The motion dated March 1, 2019, is predicated on eight grounds and an affidavit of urgency among which the issues being a pre-election suit must by law be determined within 60 days.
